Welcome to The Foundry. By accessing or using thefoundryaudio.com (the "Site") or purchasing our products, you agree to the following terms.

1. Overview

The Foundry sells digital sample libraries, Kontakt instruments, and sound content ("Products") for use in music production. These Terms govern your use of the Site and any Products purchased through it.

2. Products and Licensing

All Products are licensed, not sold. Your use of any Product is governed by the End User License Agreement (EULA) included below and provided with every download. By purchasing a Product, you agree to the terms of the EULA in addition to these Terms.

3. Purchases and Payment

All prices are listed in USD and are subject to change without notice. Payment is due in full at time of purchase. You are responsible for providing accurate billing information.

4. Refunds

All purchases are final. See our Refund Policy for details on replacements for defective files.

5. Account Responsibility

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login information and for all activity under your account.

6. Intellectual Property

All content on the Site — including but not limited to product demos, images, branding, and written content — is the property of The Foundry and may not be copied, reproduced, or distributed without permission.

7. Prohibited Use

You may not use the Site to violate any law, infringe on intellectual property rights, upload malicious code, or attempt to gain unauthorized access to our systems or other users' accounts.

8. Disclaimer of Warranties

The Site and Products are provided "as is" without warranties of any kind, express or implied. We do not guarantee that Products will be free of errors or compatible with all software/hardware configurations.

9. Limitation of Liability

The Foundry is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Site or Products.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Puerto Rico, without regard to conflict of law principles.

End User License Agreement

All products by The Foundry are licensed, not sold. By downloading, installing, or using this product, you agree to the terms of this license.

This license grants you a non-exclusive, non-transferable right to use the sounds, samples, instruments, presets, and other audio content included with this product ("the Content") in your own original musical compositions and productions.

You may:

  • Use the Content in original musical compositions and productions
  • Use those compositions in commercial projects including film, TV, trailers, advertising, video games, podcasts, and online media
  • License, distribute, stream, or sell your finished compositions that include the Content as part of a larger musical work
  • Export and deliver full mixes, alternate mixes, stems, and work parts from your original compositions and productions
  • Install the product on multiple machines owned by you, provided it is only used by the licensed user

You may not:

  • Resell, sublicense, share, distribute, lend, or transfer this product, in whole or in part
  • Repackage or redistribute the Content as part of another sample library, virtual instrument, preset pack, or competing product
  • Upload or distribute the Content as isolated audio files on stock libraries, marketplaces, file-sharing platforms, or similar services
  • Use or license the Content in isolation or substantially in isolation as a standalone sound effect, trailer sound-design element, impact, riser, transition, stinger, or similar editorial asset
  • Make the Content available in any way that allows others to extract or use it independently of your finished composition or production

Royalty-Free Usage

All Content included with this product is royalty-free when incorporated into your original musical compositions and productions. This includes the normal delivery and licensing of full mixes, alternate mixes, stems, and work parts.

Royalty-free usage does not include the independent use, sale, distribution, or licensing of the Content as standalone sounds or sound-design assets.

Refunds

Due to the digital nature of this product, purchases are non-refundable once downloaded.

Liability

The Foundry is not liable for any direct or indirect damages arising from the use of this product.
